使用条款

BaliKula是一个在线平台，连接印度尼西亚巴厘岛的设备所有者（"房东"）与希望租赁这些设备的人（"租客"）。 BaliKula专门促进可交付实物商品的租赁，如音响设备、电脑设备、运动器材、内容创作设备以及任何其他便携式物品或设备。 BaliKula不提供空间、工作室、别墅或任何其他房地产的租赁。

要使用BaliKula，您必须： - 年满18岁 - 在注册或提交请求时提供准确和最新的信息 - 遵守适用的印度尼西亚法律 房东账户需要通过我们团队的人工验证后才能激活。

作为BaliKula的房东，您同意： - 提供准确和诚实的设备描述 - 保持列表的可用性日历更新 - 确保列出的设备状况良好并与描述相符 - 在合理的时间内回复预订请求（建议24小时） - 按约定条件交付租赁设备 - 遵守与租客约定的租赁条款

作为BaliKula的租客，您同意： - 提交请求时提供准确的联系方式（姓名、电子邮件、电话） - 小心使用租赁设备并按其预期用途使用 - 在约定的时间内以收到时的状态归还设备 - 在设备交接时直接向房东现金支付 - 及时向房东报告任何损坏或故障

BaliKula的预订流程如下： 1. 租客提交包含所需日期和联系方式的预订请求 2. BaliKula检查所请求日期的可用性 3. 房东收到通知，可以接受或拒绝请求 4. 接受后，租客的联系方式将分享给房东 5. 房东通过WhatsApp联系租客安排交接 6. 在设备交接时以现金支付 BaliKula平台不处理任何付款。

BaliKula仅作为匹配中介。平台： - 不是房东和租客之间租赁协议的当事方 - 不收取或处理任何付款 - 不提供设备的任何保险或保证 - 不验证租客的身份（除提供的信息外） - 不控制列出设备的状况、质量或合规性 所有金融交易直接在房东和租客之间进行，在平台之外。

BaliKula不对以下情况承担责任： - 租赁期间设备的损坏 - 房东和租客之间的纠纷，包括关于付款、设备状况或归还期限的分歧 - 因取消或违反双方约定条款而造成的经济损失 - 与使用租赁设备相关的任何人身伤害 - 用户提供信息的准确性 建议用户在交接前检查设备，并在彼此之间约定明确的条款。

BaliKula收集以下数据： - 房东：姓名、电子邮件、WhatsApp号码、头像、简介 - 租客：姓名、电子邮件、电话号码、请求消息 租客的联系方式（姓名、电子邮件、电话）仅在房东确认预订后才会分享。更多详情，请参阅我们的隐私政策。

BaliKula保留在以下情况下无需事先通知暂停或终止任何房东账户的权利： - 违反本使用条款 - 发布欺诈性、误导性或不合规的列表 - 对其他用户的滥用行为 - 反复未能回应预订请求 - 任何被认为违背平台或其用户利益的活动

BaliKula平台上的所有内容（标志、设计、文本、源代码、功能）是BaliKula的专有财产，受适用知识产权法保护。 房东保留其列表照片和描述的所有权，但授予BaliKula在平台上展示的非独占许可。

BaliKula保留随时修改本使用条款的权利。用户将通过电子邮件或平台通知获知重大变更。修改后继续使用平台即表示接受新条款。

本使用条款受印度尼西亚法律管辖。如发生与本条款的解释或执行相关的争议，各方应努力寻求友好解决。如无法达成，登巴萨（巴厘岛，印度尼西亚）的主管法院将拥有专属管辖权。

You agree to indemnify, defend, and hold harmless BaliKula, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to: your use of the platform, any transaction between you and another user, your violation of these Terms of Use, or your violation of any rights of a third party. This indemnification obligation shall survive the termination of your account.

BaliKula shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including natural disasters (earthquakes, volcanic eruptions, tsunamis, floods), government actions, pandemics, internet outages, power failures, civil unrest, war, or any other unforeseeable event.

BaliKula does not inspect, certify, test, or verify that any equipment listed on the platform meets safety standards. Hosts are solely responsible for equipment safety. Renters assume all risk associated with the use of rented equipment. BaliKula disclaims all liability for personal injury, property damage, or any other loss arising from the use of equipment rented through the platform.

Communications between users conducted via WhatsApp, email, or any other third-party messaging platform are entirely outside BaliKula's control. BaliKula is not responsible for the content, timing, delivery, or reliability of messages exchanged between users on third-party platforms.

Nothing in these Terms of Use shall be construed as creating an employment relationship, agency relationship, partnership, joint venture, or franchise between BaliKula and any user. Hosts and Renters are independent parties acting on their own behalf.

To the maximum extent permitted by Indonesian law, BaliKula's total aggregate liability for any and all claims shall not exceed IDR 0 (zero), reflecting the fact that BaliKula provides its services free of charge and does not collect any fees or commissions from users.
