Welcome to BaliKula. By accessing our platform and using our services, you agree to these Terms of Use. Please read them carefully before using the platform.
1. Purpose of the Service
BaliKula is an online platform that connects equipment owners ("Hosts") with people who wish to rent that equipment ("Renters") in Bali, Indonesia.
BaliKula exclusively facilitates the rental of deliverable physical goods such as sound equipment, computer gear, sports equipment, content creation gear, and any other portable object or equipment.
BaliKula does NOT offer the rental of spaces, studios, villas, or any other real estate.
2. Eligibility
To use BaliKula, you must:
- Be at least 18 years old
- Provide accurate and up-to-date information when registering or submitting a request
- Comply with applicable Indonesian laws
Host accounts are subject to manual verification by our team before activation.
3. Host Obligations
As a Host on BaliKula, you agree to:
- Provide accurate and honest descriptions of your equipment
- Keep the availability calendar of your listings up to date
- Ensure that listed equipment is in good working condition and matches its description
- Respond to booking requests within a reasonable timeframe (24 hours recommended)
- Hand over rented equipment in the agreed-upon condition
- Respect the rental terms agreed upon with the Renter
4. Renter Obligations
As a Renter on BaliKula, you agree to:
- Provide accurate contact details (name, email, phone) when submitting a request
- Use rented equipment with care and according to its intended purpose
- Return equipment in the condition it was received, within the agreed timeframe
- Make cash payment directly to the Host at the time of equipment handover
- Report any damage or malfunction to the Host promptly
5. Booking Process
The booking process on BaliKula works as follows:
1. The Renter submits a booking request with desired dates and contact details
2. BaliKula checks availability for the requested dates
3. The Host is notified and can accept or decline the request
4. Upon acceptance, the Renter's contact details are shared with the Host
5. The Host contacts the Renter via WhatsApp to arrange the handover
6. Payment is made in cash at the time of equipment handover
No payment is processed by the BaliKula platform.
6. Platform Role
BaliKula acts exclusively as a technology intermediary. It is NOT a party to any rental agreement, does NOT own any listed items, does NOT guarantee item quality or availability, and does NOT process any financial transactions. All payments occur directly between Host and Renter, off-platform, in cash.
More specifically, the platform:
- Is NOT a party to the rental agreement between the Host and the Renter
- Does not collect or process any payments
- Does not provide any insurance or guarantee on the equipment
- Does not verify Renter identity beyond the information provided
- Does not control the condition, quality, or compliance of listed equipment
- Does not take any commission or fee on transactions between users
All financial transactions take place directly between the Host and the Renter, outside the platform. BaliKula bears no responsibility whatsoever for the execution, quality, or outcome of any rental transaction.
7. Limitation of Liability
BaliKula shall not be held liable for:
- Damage to equipment during the rental period
- Disputes between Hosts and Renters, including disagreements regarding payment, equipment condition, or return deadlines
- Financial losses resulting from cancellation or breach of terms agreed between the parties
- Any personal injury related to the use of rented equipment
- The accuracy of information provided by users
Users are encouraged to inspect equipment before handover and agree on clear terms between themselves.
8. Data Protection
BaliKula collects the following data in accordance with Indonesia's Personal Data Protection Law (Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi, commonly known as 'UU PDP'):
- Hosts: name, email, WhatsApp number, profile photo, bio
- Renters: name, email, phone number, request message
Renter contact details (name, email, phone) are only shared with the Host after the Host confirms the booking. All data processing is carried out on valid legal grounds as defined by UU PDP. For more details, see our Privacy Policy.
9. Account Suspension and Termination
BaliKula reserves the right to suspend or terminate any Host account, without prior notice, in the following cases:
- Violation of these Terms of Use
- Publication of fraudulent, misleading, or non-compliant listings
- Abusive behavior toward other users
- Repeated failure to respond to booking requests
- Any activity deemed contrary to the interests of the platform or its users
10. Intellectual Property
All content on the BaliKula platform (logo, design, text, source code, features) is the exclusive property of BaliKula and is protected by applicable intellectual property laws.
Hosts retain ownership of their listing photos and descriptions but grant BaliKula a non-exclusive license to display them on the platform.
11. Modification of Terms
BaliKula reserves the right to modify these Terms of Use at any time. Users will be notified of substantial changes by email or via a platform notification. Continued use of the platform after modification constitutes acceptance of the new terms.
12. Governing Law and Jurisdiction
These Terms of Use are governed by Indonesian law. In the event of a dispute relating to the interpretation or performance of these terms:
1. The parties shall first attempt resolution through good-faith negotiation for a period of thirty (30) calendar days from the date of written notice of the dispute.
2. If the dispute is not resolved through negotiation, the parties shall submit the dispute to mediation administered by BANI (Badan Arbitrase Nasional Indonesia), if available, before resorting to litigation.
3. Failing resolution through negotiation or mediation, the competent courts of Denpasar (Bali, Indonesia) shall have exclusive jurisdiction.

14. Indemnification
You agree to indemnify, defend, and hold harmless BaliKula, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of, or inability to use, the platform
- Any transaction or interaction between you and another user, including but not limited to the rental, handover, use, damage, or return of equipment
- Your violation of these Terms of Use
- Your violation of any rights of a third party, including intellectual property rights, privacy rights, or contractual rights
- Any content you submit, post, or transmit through the platform
This indemnification obligation shall survive the termination of your account and your use of the platform.
15. Force Majeure
BaliKula shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to:
- Natural disasters (earthquakes, volcanic eruptions, tsunamis, floods, landslides)
- Government actions, regulations, or restrictions
- Pandemics, epidemics, or public health emergencies
- Internet outages, telecommunications failures, or power failures
- Civil unrest, riots, strikes, or acts of terrorism
- War or armed conflict
- Any other event that could not reasonably have been foreseen or prevented
In the event of force majeure, BaliKula's obligations shall be suspended for the duration of the event. BaliKula shall use reasonable efforts to notify users and resume normal operations as soon as practicable.
16. Equipment Safety Disclaimer
BaliKula does not inspect, certify, test, or verify that any equipment listed on the platform meets Indonesian safety standards (SNI — Standar Nasional Indonesia), international safety standards, or any other regulatory requirements.
Hosts are solely responsible for ensuring that their listed equipment is safe for its intended use, properly maintained, and compliant with all applicable regulations. Hosts must disclose any known defects, hazards, or safety concerns in their listing descriptions.
Renters assume all risk associated with the use of rented equipment. Renters are strongly encouraged to:
- Inspect equipment thoroughly before accepting handover
- Request safety instructions or operating manuals from the Host
- Refrain from using equipment they are not trained or qualified to operate
- Use appropriate personal protective equipment where applicable
BaliKula disclaims all liability for personal injury, property damage, or any other loss arising from the use of equipment rented through the platform.
17. Third-Party Communications
Communications between users conducted via WhatsApp, email, or any other third-party messaging platform are entirely outside BaliKula's control. BaliKula is not responsible for:
- The content, accuracy, or legality of messages exchanged between users
- The timing, delivery, or reliability of messages sent through third-party platforms
- Any agreements, promises, or representations made by users outside the BaliKula platform
- Any disputes arising from communications conducted through third-party services
Users acknowledge that WhatsApp and other third-party messaging services are governed by their own terms of service and privacy policies, over which BaliKula has no control.
18. No Employment or Agency Relationship
Nothing in these Terms of Use shall be construed as creating an employment relationship, agency relationship, partnership, joint venture, or franchise between BaliKula and any user.
Hosts and Renters are independent parties acting on their own behalf. Hosts are not employees, agents, or representatives of BaliKula. BaliKula does not direct, control, or supervise the activities of Hosts or Renters.
No user is authorized to make any representation, warranty, or commitment on behalf of BaliKula.
19. Maximum Liability Cap
To the maximum extent permitted by Indonesian law (including but not limited to the Indonesian Civil Code and Law No. 11 of 2008 on Electronic Information and Transactions, as amended):
BaliKula's total aggregate liability to any user for any and all claims, damages, losses, or causes of action arising out of or related to these Terms of Use or the use of the platform shall not exceed IDR 0 (zero Indonesian Rupiah).
This limitation reflects the fact that BaliKula provides its services entirely free of charge and does not collect any fees, commissions, or payments from users. BaliKula is a free technology intermediary and assumes no financial responsibility for transactions, interactions, or disputes between users.
This limitation of liability applies regardless of the legal theory upon which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if BaliKula has been advised of the possibility of such damages.
Nothing in this section shall exclude or limit liability that cannot be excluded or limited under applicable Indonesian law.
